Terms of Use

  • Acceptance of Terms
    Welcome to GameChanger! These Terms of Use ("Terms") govern your access to and use of the GameChanger website and mobile application (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
  • Eligibility
    You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a company, organization, or another legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
  • Account Registration
    To access certain features of the Service, you may be required to register for an account. When you register for an account, you agree to provide accurate and complete information and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify GameChanger immediately of any unauthorized use of your account or any other breach of security. GameChanger will not be liable for any loss or damage arising from your failure to comply with this section.
  • Use of the Service
    The Service is provided for your personal, non-commercial use. You agree not to use the Service for any illegal or unauthorized purpose. You also agree not to:
    • Use the Service in a manner that violates any applicable laws, regulations, or guidelines.
    • Interfere with or disrupt the Service or servers or networks connected to the Service.
    • Use any data mining, robots, or similar data gathering and extraction methods in connection with the Service.
    • Upload, post, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
    • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
    • Upload, post, or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Intellectual Property
    The Service and its contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by GameChanger, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
    You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Service, except as follows:
    • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
    • You may store files that are automatically cached by your web browser for display enhancement purposes.
    • You may print or download one copy of a limited amount of material from different areas of the Service for your personal, non-commercial use and not for further reproduction, publication, or distribution.
    • If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
    You must not:
    • Modify copies of any materials from the Service.
    • Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
    • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Service.

  • User Content
    The Service allows users to submit, post, and share content, including but not limited to text, photos, audio, video, or other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the Service. However, by submitting User Content to GameChanger, you grant GameChanger a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
    You represent and warrant that:
    • You own or control all rights in and to the User Content that you post or otherwise distribute, or you otherwise have the right to grant the rights and licenses granted in these Terms.
    • The User Content that you post or otherwise distribute, and your use of the Service, does not violate these Terms and will not violate any rights of or cause injury to any person or entity.
    GameChanger does not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any User Content or communications posted via the Service or endorse any opinions expressed via the Service. You understand that by using the Service, you may be exposed to User Content that might be offensive, harmful, inaccurate, or otherwise inappropriate, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against GameChanger with respect to such User Content.
  • Termination
    We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason and without limitation, including but not limited to a breach of the Terms.
    If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
  • Indemnification
    You agree to defend, indemnify, and hold harmless GameChanger, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from or arising out of your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
  • Limitation of Liability
    In no event will GameChanger, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Service, any websites linked to it, any content on the Service, or such other websites or any services or items obtained through the Service or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
    The foregoing does not affect any liability which cannot be excluded or limited under applicable law.
  • Governing Law and Jurisdiction
    These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
    Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by the courts of India. The use of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
  • General
    These Terms constitute the entire agreement between you and GameChanger regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and GameChanger. You may not assign or delegate any rights or obligations under these Terms. We may assign or delegate these Terms in our sole discretion.
    Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
  • Changes to the Terms
    We reserve the right, at our sole discretion, to amend these Terms at any time and without prior notice. We will notify you of any changes by posting the new Terms on this page.
    You are advised to review this Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page. Your continued use of the Service after any changes to these Terms will constitute your acceptance of such changes.
